Former Kaduna State Governor Nasir El Rufai has filed a N1 billion fundamental rights enforcement suit against the Independent Corrupt Practices and Other Related Offences Commission over what he describes as an unlawful search of his Abuja residence. The suit was filed on February 20 at the Federal High Court in Abuja.
El Rufai is asking the court to declare that the search carried out at his home on February 19 was illegal and a violation of his constitutional right to privacy.
Through his lead counsel Oluwole Iyamu SAN, he argues that the search warrant used by the commission was defective and lacked proper legal foundation.
He is also seeking an order declaring that any items recovered during the operation are inadmissible in court.
The former governor is demanding N1 billion in damages for alleged psychological trauma, emotional distress, and what he calls a high handed invasion of his home.
The case is now before the Federal High Court in Abuja and is awaiting further proceedings.
