The Federal High Court in Abuja has dismissed an application by 2027 African Action Congress (AAC) presidential candidate Omoyele Sowore seeking to compel Department of State Services (DSS) Director-General Tosin Ajayi to testify personally in his alleged cyberbullying trial involving President Bola Tinubu.
Justice Mohammed Umar ruled that the subpoena concerned official DSS activities, not the director-general’s personal actions, and that another agency official could testify on its behalf.
Sowore’s lawyer, Adeyinka Fusika, a Senior Advocate of Nigeria (SAN), had sought to compel Ajayi to testify about the agency’s official activities relating to the case.
However, DSS counsel Akinlolu Kehinde, also a SAN, opposed the application, arguing that any authorised official could provide the required evidence.
Following the ruling, defence counsel Olumide Fusika called Michael Jego, a DSS investigating officer, as the third defence witness. Jego began giving evidence as the trial continued.
